Welcome to QADAR BEAU.

These Terms of Service (“Terms”) govern your access to and use of www.qadarbeau.com (the “Site”), including any purchases, services, features, content, communications, and other interactions made available through the Site.

The Site is operated by QADAR BEAU LLC (“QADAR BEAU,” “we,” “us,” or “our”).

By visiting the Site, browsing our products, creating an account, submitting information, communicating with us, or purchasing a product, you agree to these Terms and any policies referenced in them.

If you do not agree to these Terms, you should not use the Site or purchase products through it.

1. ABOUT QADAR BEAU

QADAR BEAU LLC is an apparel, accessories, footwear, and lifestyle ecommerce brand.

Our online store is hosted and supported by Shopify. Shopify provides the ecommerce technology that allows us to display products, process orders, facilitate checkout, and operate portions of the Site.

Purchases made from QADAR BEAU are transactions directly between you and QADAR BEAU LLC. Shopify and other service providers are not the seller of QADAR BEAU products unless expressly stated otherwise.

Some QADAR BEAU products are created, printed, manufactured, or fulfilled by third-party production and fulfillment partners on our behalf.

2. ELIGIBILITY TO USE THE SITE

By using the Site, you represent that you are:

  • at least the age of majority in your state or jurisdiction; or

  • using the Site with the permission and supervision of a parent or legal guardian.

You may not use the Site or our products for unlawful purposes or in violation of applicable laws or regulations.

We reserve the right to refuse service, restrict access, cancel orders, or terminate accounts when reasonably necessary to protect QADAR BEAU, our customers, our service providers, or the integrity of the Site.

3. PRODUCT INFORMATION

We make reasonable efforts to provide accurate product descriptions, photographs, dimensions, materials, sizing information, colors, features, pricing, and availability.

However, because products are viewed through different screens and devices, we cannot guarantee that your device will display colors or product details exactly as they appear in person.

Product photographs may include:

  • styled or editorial photography;

  • lifestyle imagery;

  • mockups;

  • digital product representations;

  • mannequins or models;

  • AI-assisted or digitally produced creative imagery where appropriate.

Product specifications, measurements, materials, sizing, and other factual product information provided on the applicable product page should be used when making a purchase decision.

Where a visual representation conflicts with written product specifications, the written product specifications control unless we expressly state otherwise.

4. MADE-TO-ORDER AND THIRD-PARTY FULFILLMENT

Many QADAR BEAU products are produced or fulfilled after an order is placed.

This may include print-on-demand, cut-and-sew, sublimation, direct-to-garment printing, embroidery, direct-to-film printing, or other production processes.

Because products may be individually produced:

  • minor variations in print positioning, stitching, fabric appearance, or finishing may occur;

  • production time is separate from carrier shipping time;

  • orders may enter production shortly after purchase;

  • changes or cancellations may not be possible after fulfillment begins.

Minor manufacturing or print variations that fall within normal production tolerances are not necessarily considered defects.

Nothing in this section limits your rights concerning products that are materially defective, damaged, incorrect, or otherwise eligible for return or refund under our Refund Policy or applicable law.

5. PRODUCT AVAILABILITY

Products and quantities shown on the Site are subject to availability.

We may:

  • limit quantities;

  • discontinue products;

  • update product specifications;

  • change colors, variants, or styles;

  • restrict sales by customer, location, or order;

  • remove products from the Site;

  • cancel an unavailable item or order.

If an item becomes unavailable after your order is placed, we may contact you regarding available options or issue an appropriate refund.

We will not substitute a materially different product without your authorization.

6. PRICING

Prices are displayed in U.S. dollars unless otherwise stated.

We may change product prices at any time before an order is placed.

A price change after you complete an order does not ordinarily affect the price already accepted for that order.

We are not required to retroactively apply later promotions, sale prices, discount codes, or pricing changes to completed purchases unless we specifically state otherwise.

If a product is listed at an obviously incorrect price because of a typographical, technical, or system error, we reserve the right to correct the error and cancel or decline the affected order. If payment has already been collected for an order we cancel, the applicable amount will be refunded.

7. TAXES

Applicable sales tax or other taxes may be calculated and collected based on the order, shipping destination, sales channel, applicable law, and the services used to process your purchase.

The amount shown during checkout will reflect taxes collected through that checkout when applicable.

8. ORDERS AND ORDER ACCEPTANCE

Submitting an order does not guarantee acceptance.

After you place an order, you may receive an electronic order confirmation. This confirms that we received your order but does not prevent us from reviewing the transaction for:

  • payment authorization;

  • suspected fraud;

  • product availability;

  • pricing errors;

  • shipping limitations;

  • duplicate orders;

  • other legitimate order-processing concerns.

We reserve the right to decline or cancel an order when reasonably necessary.

If we cancel an order after payment has been collected, we will refund the applicable amount to the original payment method.

9. ACCURATE ORDER INFORMATION

You agree to provide accurate, complete, and current information when placing an order.

You are responsible for reviewing:

  • your name;

  • email address;

  • shipping address;

  • billing information;

  • product;

  • size;

  • color;

  • quantity;

  • other product selections

before submitting your order.

You should contact us immediately if you notice an error after checkout.

Because fulfillment can begin quickly, we cannot guarantee that order details or shipping information can be changed after an order has been submitted.

10. ORDER CHANGES AND CANCELLATIONS

Orders cannot generally be modified after checkout.

Cancellation may be possible if you contact us within 12 hours of purchase, but cancellation is not guaranteed.

If an order has entered production, fulfillment, or shipping preparation, we may no longer be able to stop or change it.

11. PAYMENT

Payment must be successfully authorized before an order can be completed.

Available payment methods are displayed during checkout and may change from time to time.

Payments may be processed by Shopify Payments, PayPal, or other authorized payment processors.

We do not directly control a third-party payment provider's approval decisions, security procedures, processing times, or account requirements.

You represent that you are authorized to use any payment method submitted with your order.

12. DISCOUNTS, PROMOTIONS, AND OFFERS

QADAR BEAU may periodically offer:

  • discount codes;

  • automatic discounts;

  • promotional pricing;

  • bundle offers;

  • subscriber incentives;

  • limited-time promotions;

  • free-shipping promotions;

  • other customer rewards.

Unless otherwise stated:

  • promotions may have eligibility requirements;

  • promotions may have expiration dates;

  • promotions may not be combinable;

  • promotions have no cash value;

  • promotions may be modified or discontinued before an order is placed;

  • an offer cannot be applied retroactively to a completed purchase.

Any specific promotional terms presented with an offer are incorporated into these Terms.

13. FREE SHIPPING OFFER

QADAR BEAU currently offers automatic free U.S. shipping on eligible orders of $150 or more.

No promotional code is required.

Eligibility is determined through the checkout system based on the order and applicable shipping conditions.

The free-shipping offer applies only where the applicable order and shipping destination qualify.

QADAR BEAU may modify or discontinue future free-shipping offers, but changes will not retroactively alter an already completed order.

14. SHIPPING AND FULFILLMENT

QADAR BEAU currently ships within the United States.

Most products require approximately 2–5 business days for production and fulfillment before shipping.

Standard U.S. delivery is generally estimated at approximately 5–7 business days after fulfillment, although delivery estimates are not guarantees.

Carrier delays, severe weather, holidays, incorrect addresses, supply-chain interruptions, or circumstances outside our reasonable control may affect delivery.

Once an order ships, tracking information is generally provided electronically.

15. LOST, DAMAGED, OR INCORRECT ORDERS

Please inspect your order when it arrives.

If your order:

  • arrives damaged;

  • contains an incorrect item;

  • contains a materially defective item; or

  • appears to have been lost in transit,

Include your order number and, when appropriate, photographs showing the issue.

For packages marked delivered but not received, we may ask you to contact the shipping carrier or review the delivery location while we assist in evaluating the situation.

Claims are handled based on the specific circumstances, available documentation, fulfillment information, carrier records, and applicable law.

16. RETURNS

QADAR BEAU currently maintains a 30-day return policy.

You have 30 days after receiving an eligible item to request a return.

To qualify, the item generally must be:

  • in the same condition in which it was received;

  • unworn or unused;

  • accompanied by tags when applicable;

  • in its original packaging; and

  • accompanied by receipt or proof of purchase.

Returns must be approved before merchandise is sent back.

17. NON-RETURNABLE AND FINAL-SALE ITEMS

Certain products may be non-returnable where identified by the Refund Policy, product page, promotion, or applicable law.

Our current policy treats:

  • sale items; and

  • gift cards

as final sale unless otherwise required by applicable law.

Additional exclusions may apply to custom, personalized, hygiene-sensitive, perishable, hazardous, or other products where returns are not reasonably permitted.

Where a specific product page provides different return information, review that information before completing your purchase.

18. REFUNDS

Approved refunds are issued to the original payment method after the returned merchandise has been received and inspected when inspection is required.

After we approve and issue a refund, your financial institution or payment provider may require additional time to post the funds to your account.

19. EXCHANGES

Unless otherwise stated, the most reliable way to exchange an item is to return the eligible original product in accordance with our Refund Policy and place a separate order for the replacement product.

Availability of a replacement size, color, or style is not guaranteed.

20. CUSTOMER ACCOUNTS

Certain Site features may allow you to create or use a customer account.

You are responsible for:

  • maintaining the confidentiality of your login credentials;

  • activity conducted through your account;

  • providing accurate account information;

  • notifying us if you suspect unauthorized use.

We may suspend or terminate accounts associated with suspected fraud, abuse, unlawful activity, attempts to interfere with the Site, or material violations of these Terms.

21. EMAIL COMMUNICATIONS

If you subscribe to QADAR BEAU marketing emails, we may send you information concerning:

  • promotions;

  • brand news;

  • offers;

  • recommendations;

  • events;

  • other marketing communications.

You may unsubscribe from marketing email using the unsubscribe mechanism provided in the message.

Unsubscribing from marketing communications does not prevent us from sending transactional or service-related messages necessary to manage an order, account, return, refund, security issue, or other existing customer relationship.

22. SMS AND MOBILE MESSAGING

If you separately enroll in a QADAR BEAU SMS or mobile messaging program, you consent to receive text messages at the telephone number you provide in accordance with the disclosures presented when you enroll.

Messages may include marketing, promotional, cart-related, order-related, or other messages depending on the program for which you enroll.

Where applicable:

  • message frequency may vary;

  • message and data rates may apply;

  • consent to marketing texts is not a condition of purchasing goods;

  • messages may be sent using automated technology where permitted;

  • carrier availability and delivery are not guaranteed.

You may revoke consent to marketing texts at any time.

Reply STOP to unsubscribe where supported.

You may also use another reasonable method of communicating that you no longer wish to receive marketing texts from us.

We may send one final message confirming an opt-out where permitted by law.

Transactional communications that are separately authorized or legally permitted may be treated differently from marketing communications.

23. PALOMA AND AI-ASSISTED SHOPPING FEATURES

QADAR BEAU may provide AI-assisted shopping, styling, product-discovery, recommendation, or conversational features, including features presented through Paloma.

These tools are intended to help you explore products and make shopping easier.

AI-assisted responses may rely on:

  • product descriptions;

  • product specifications;

  • sizing information;

  • catalog metadata;

  • styling information;

  • other QADAR BEAU data.

AI-generated or automated recommendations are informational and may occasionally be incomplete or incorrect.

They do not guarantee:

  • exact fit;

  • product compatibility;

  • color accuracy;

  • inventory;

  • suitability for a particular purpose;

  • future availability;

  • individual results.

You should review the actual product page, specifications, size information, price, and checkout information before purchasing.

When an AI recommendation conflicts with verified product specifications displayed on the product page, the verified product information controls.

24. REVIEWS, COMMENTS, AND CUSTOMER CONTENT

The Site may allow customers to submit reviews, photographs, comments, feedback, testimonials, or other content.

You agree that content you submit will not:

  • knowingly contain false or misleading statements;

  • violate another person's intellectual property rights;

  • contain unlawful, threatening, abusive, defamatory, or obscene material;

  • contain malware or harmful code;

  • impersonate another person;

We may moderate, decline, remove, or restrict customer content when reasonably necessary.

If you knowingly submit photographs, reviews, testimonials, or other content through a feature that requests content for publication, you grant QADAR BEAU a non-exclusive, worldwide, royalty-free license to display, reproduce, format, and use that submitted content in connection with the Site, our products, customer communications, and QADAR BEAU marketing, subject to applicable law and any additional terms presented when the content is submitted.

You retain ownership of your original content.

We will not treat merely tagging QADAR BEAU on an unrelated social media post as automatic permission to commercially reuse your content where additional permission is required.

25. INTELLECTUAL PROPERTY

The Site and its original content, including QADAR BEAU branding, graphics, artwork, designs, photography, written copy, layouts, logos, product presentations, and other materials owned by QADAR BEAU are protected by intellectual property laws where applicable.

Except where expressly permitted, you may not:

  • reproduce;

  • republish;

  • distribute;

  • sell;

  • commercially exploit;

  • scrape;

  • modify;

  • create unauthorized derivative works from

QADAR BEAU-owned Site content.

Nothing in these Terms transfers ownership of QADAR BEAU intellectual property to you.

Third-party trademarks, copyrights, and other intellectual property appearing on the Site remain the property of their respective owners.

26. COPYRIGHT OR INTELLECTUAL PROPERTY CONCERNS

Product-specific warranties, if any, will be governed by the applicable product information and law.

35. LIMITATION OF LIABILITY

To the fullest extent permitted by law, QADAR BEAU LLC and its owners, officers, employees, agents, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses arising solely from your use or inability to use the Site.

Where liability cannot legally be excluded, any limitation will apply only to the maximum extent permitted by applicable law.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or restricted, nor does it eliminate consumer remedies provided by mandatory law.

36. INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless QADAR BEAU LLC and its officers, owners, employees, agents, and affiliates from third-party claims, damages, liabilities, or reasonable expenses arising from:

  • your unlawful use of the Site;

  • your material violation of these Terms;

  • content you knowingly submit in violation of another party's rights; or

  • fraud or intentional misconduct by you.

This section does not require you to indemnify QADAR BEAU for claims resulting from QADAR BEAU's own unlawful conduct where such indemnification is prohibited by law.

37. EVENTS OUTSIDE OUR REASONABLE CONTROL

QADAR BEAU is not responsible for delays or failures caused by events outside our reasonable control, including:

  • severe weather;

  • natural disasters;

  • transportation disruptions;

  • carrier interruptions;

  • labor disruptions;

  • government actions;

  • internet or infrastructure failures;

  • supplier interruptions;

  • widespread technical outages;

  • other comparable events.

If such an event materially affects an order, we will take reasonable steps appropriate to the circumstances.

38. GOVERNING LAW

These Terms and transactions with QADAR BEAU LLC are governed by the laws of the State of Delaware and applicable federal law, without regard to conflict-of-law principles, to the extent that such a choice of law is legally enforceable.

Mandatory consumer-protection rights that apply to you under the laws of your state and cannot lawfully be waived remain unaffected.

39. DISPUTES AND VENUE

Before filing a lawsuit concerning a purchase or these Terms, we encourage you to contact us so that we have a reasonable opportunity to resolve the matter.

Unless applicable law provides otherwise, legal proceedings arising from these Terms or a transaction with QADAR BEAU may be brought in a court of competent jurisdiction located in Delaware.

Nothing in this section prevents a consumer from exercising rights that applicable law expressly permits to be brought in another jurisdiction or forum.

40. SEVERABILITY

If a court determines that part of these Terms is invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent legally permissible or severed where necessary.

The remaining provisions will continue in effect.

41. NO WAIVER

If QADAR BEAU does not immediately enforce a provision of these Terms, that does not automatically waive our right to enforce it later.

A waiver on one occasion does not constitute a continuing waiver.

42. ASSIGNMENT

You may not assign your rights or obligations under these Terms without our consent where consent is legally required.

QADAR BEAU may assign these Terms in connection with a merger, acquisition, reorganization, sale of substantially all business assets, or similar business transaction, subject to applicable law.

43. TERMINATION

These Terms remain effective while you use the Site.

We may terminate or restrict your access to Site features if you materially violate these Terms or engage in unlawful, fraudulent, abusive, or security-threatening conduct.

Provisions that by their nature should survive termination—including intellectual property, payment obligations, disclaimers, limitations of liability, dispute provisions, and other accrued rights—will survive to the extent legally appropriate.

44. CHANGES TO THESE TERMS

We may update these Terms to reflect:

  • changes to our business;

  • Site features;

  • technology;

  • products;

  • policies;

  • legal requirements;

  • service providers;

  • operational practices.

When we make material changes, we will update the “Last Updated” date.

Changes apply prospectively unless otherwise permitted or required by law.

Your continued use of the Site after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.

45. ENTIRE AGREEMENT

These Terms, together with the policies and terms expressly referenced in them, constitute the agreement governing your use of the Site and purchases from QADAR BEAU.
